2008 Official Rules

Win a FREE Hawaii Holiday Official Contest Rules

Shell Vacations Hospitality invites any hotel guest 18 years of age or older to participate in the Winter Fun Contest by submitting a digital photograph for possible publication on the www.shellhospitality.com website. To submit a photograph, between January 7, 2008 through March 31, 2008, click on the "Submit Your Photo" button below and follow the step-by-step directions on that page. Limit one photograph submission per person. To be eligible, your picture must include a visable image of at least one person. Winner will receive Four Nights accommodations at the Paniolo Greens Resort in Waikoloa, Hawaii.*

You must be a United States citizen or resident of 18 years of age or older to submit a photograph.

Terms & Conditions

By submitting a photograph for consideration, you warrant and represent that the photograph you submit (the "Photograph") is your own original work, that you alone own or otherwise have all necessary rights to the Photograph, that it is an authentic and accurate depiction of the subject matter presented, and that no other party has any right, title, claim or interest in the Photograph; and you grant to Shell Vacations Hospitality ("SVH") a royalty-free, worldwide, perpetual, irrevocable, non-exclusive right and fully sub-licensable license to use, copy, reproduce, distribute, publish, publicly perform, publicly display, modify, adapt, translate, archive, store, and create derivative works from the Photograph, in whole or in part, in any medium now existing or subsequently developed for editorial purposes without further review or participation from you. All rights in this paragraph are granted without the need for additional compensation of any sort to you. SVH retains full editorial control over the selection of, and the decision not to select, any particular Photograph for publication. Without limiting the generality of the previous sentence, you authorize SVH to share the Photograph across all SVH affiliated Web sites, to place advertisements in close proximity to the Photograph, and to use your name and any other information in connection with its use of the Photograph you provide. You acknowledge that SVH and/or its designees may or may not pre-screen all Photographs submitted, and shall have the right (but not the obligation), in their sole discretion, to move, remove, or refuse any for any reason, including, without limitation, that any such Photograph violates the Terms & Conditions or is otherwise objectionable.

SVH is not responsible for computer system, hardware, software, or program malfunctions or other errors, failures, or delayed computer transactions or network connections that are human or technical in nature. Furthermore, SVH is not responsible for: (i) lost, misdirected, misplaced, illegible, unintelligible, incomplete, or late entries or (ii) any act, failure to act, or delay regarding the transmitting or processing of entries. SVH reserves the right, in its sole discretion, to cancel or suspend all or any portion of this contest without notice if factors beyond SVH's control, including technical difficulties, disrupt or corrupt the fair or secure administration or operation of the contest. Void where prohibited. SVH is entitled to interpret these rules as needed and its decisions are final. SVH reserves the right to disqualify any entrant that SVH has reason to believe is not the original work of entrant, or does not otherwise meet the contest rules. If a winner is disqualified or determined to be ineligible, an alternate winner will be selected using the same judging process/criteria described herein. Alternate winners are subject to all requirements set forth in these Official Rules.

SVH will select one (1) winning photograph from all eligible entries received on or about March 31, 2008. Winner will be notified approximately 2-3 weeks after the contest deadline by phone and email using the information submitted by the winning entrant. Along with a winner notification, winners will be sent an affidavit of eligibility and release. Winner must execute, without making changes, and return this release for receipt by SVH within 7 days of the date on the winner notification letter. Failure to execute and return this affidavit within 7 days will result in disqualification. The winning photograph, along with the photographer's name, email address (optional) and information about the photo, will be displayed on the www.shellhospitality.com website.

By participating in the contest, you agree to release and hold harmless SVH and its employees, officers, affiliates, agents, and advertising and promotional agencies from any and all damages, injuries, claims, causes of actions, or losses of any kind resulting from your participation in this contest, including infringement of intellectual property rights. SVH and its employees, officers, affiliates, agents, and advertising and promotional agencies assume no responsibility or liability for any damages, injuries, claims, causes of actions, or losses of any kind arising in whole or in part from this contest.

*Prize if for accommodations, taxes and resort fees only. Prize does not include airfare or flight reservations. Winner is solely responsible for their own travel expenses (including, but not limited to airfare, transportation to and from airport and any government imposed fees or additional charges) and transportation arrangements.

Additional Terms and Conditions

Image Modifications:
Minor digital enhancement is permitted, but images that have been significantly modified or appear unnatural will be disqualified.
Not Permitted:

• No borders or frames may be added to images.
• No watermarks, signatures, or copyright notices may be added to images.
• Adding or replacing elements in an image is not permitted.
• Artistic filters are not permitted.

• Images may be cropped and rotated as necessary as long as the rectangular format is maintained and the size is within the specifications above.
• Images may be resized as long as the aspect ratio is maintained
• Red-eye removal and spot editing
• One-step enhancement (such as "AutoFix", "QuickFix", "Auto Levels", etc.)
• Use of filters to sharpen, soften, blur, despeckle, or remove noise.
• Use of corrective functions to improve the natural appearance of the image, such as levels, contrast, brightness, curves, intensity, tone, hue, saturation, lightness, value, color balance, and tint.

Posting Rules

1. If the Photograph depicts any children under the age of 13, you need to provide written permission from the child's parent or guardian to post the Photograph.

1. Contains copyrighted or other proprietary material of any kind without the express permission of the owner of that material;
2. Contains vulgar, profane, abusive, racist or hateful language or expressions, epithets or slurs, text, photographs or illustrations in poor taste, inflammatory attacks of a personal, racial or religious nature.
3. Is defamatory, threatening, disparaging, grossly inflammatory, false, misleading, fraudulent, inaccurate, unfair, contains gross exaggeration or unsubstantiated claims, violates the privacy rights of any third party, is unreasonably harmful or offensive to any individual or community.
4. Violates any right of SVH, its affiliates or subsidiaries, or any third party.
5. Discriminates on the grounds of race, religion, national origin, gender, age, marital status, sexual orientation or disability, or refers to such matters in any manner prohibited by law.
6. Violates or inappropriately encourages the violation of any municipal, state, federal or international law, rule, regulation or ordinance.
7. Advertises, promotes or offers to trade any goods or services, except in areas specifically designated for such purpose.
8. Uploads or transmits viruses or other harmful, disruptive or destructive files.
9. Disrupts, interferes with, or otherwise harms or violates the security of Shellhospitality.com, or any services, system resources, accounts, passwords, servers or networks connected to or accessible through Shellhospitality.com or affiliated or linked sites.

WARNING: A VIOLATION OF THESE POSTING RULES MAY BE REFERRED TO LAW ENFORCEMENT AUTHORITIES.
